The European Union GDPR has set in place fines of up to 4 percent of revenue of €20M, whichever is higher, for breach of compliance requirements relating to international data transfer, and 2 percent of revenue or €10M, whichever is higher, for the less serious breaches. To put it in perspective, this is a significant increase from the current £500K limit of fine in United Kingdom. The scope of the regulation includes not only the data controllers but also the data processors. So, anyone across the world doing business in the European Union and handling EU residents’ data is affected, and organizations will no longer be able to get by with a slap-on-the-wrist punishments involving class actions or fines. In the words of Elizabeth Denham, information commissioner, “The GDPR is a strong data protection law. It gives customers more control over their data and it includes new obligations for organisations.” According to a September 2016 Gartner article, 50 percent of the organisations will be non-compliant by the end of 2018, once the EU GDPR comes into force on 25 May, 2018.
The EU GDPR will streamline the data privacy regulation, making it easier to do business and will be an opportunity if companies align the processes, implement effective training programs, and leverage the right tools to drive compliance efficiently.
